Abortion doc's trial fuels pro-life movement

Anti-abortion protesters attend the March for Life on January 25, 2013 in Washington, DC. (Brendan Hoffman/Get??

Anti-abortion activists are harnessing the outrage generated over the trial of a Philadelphia abortion doctor to pressure lawmakers to pass more restrictive abortion laws.

The activists say that the trial of 72-year-old Kermit Gosnell, which concludes Monday as attorneys on both sides make their closing arguments, shows that late-term abortions are inhumane and unsafe and should be banned.

Gosnell is accused of murdering four babies who were born alive after abortion procedures by cutting their spinal cords. He's also accused of murdering a patient, who died of a drug overdose he allegedly administered.

Gosnell faces other charges including violating Pennsylvania's law against performing abortions after 24 weeks of pregnancy; violating a state law requiring a 24-hour waiting period for patients before obtaining an abortion; and of endangering child welfare for employing a 15-year-old in the clinic that investigators labeled a "house of horrors."

Abortion foes say Gosnell's crimes are representative of larger abuses in late-term abortion clinics, while abortion rights advocates say he is a criminal outlier who would not have been stopped by more regulations.

One player in the anti-abortion movement, the Susan B. Anthony List, is lobbying for a bill to ban all abortions performed in Washington, DC after 20 weeks of pregnancy. The group has generated thousands of letters to lawmakers in support of the "D.C. Pain-Capable Unborn Child Protection Act," which was introduced by Arizona Republican Rep. Trent Franks. The group is also hoping to convince lawmakers to introduce a national version of the bill.

"What is the difference between killing a baby minutes before delivery compared to moments after? Only the barest of legal nuances," SBA List President Marjorie Dannenfelser said in a statement tying the DC law to Gosnell's alleged crimes. ?It is an outrage that in the shadow of the Capitol, children can legally have their lives ended through methods equally brutal to those employed by Gosnell."

The proposed 20-week ban is part of a wave of anti-abortion legislation that is attempting to directly challenge the Supreme Court's 1973 Roe v. Wade ruling that said the government cannot ban abortions that take place before a fetus can survive outside of the womb. (The point of viability is considered to be at about 24 weeks, though that point is debated.)

This year, 10 states have passed or are poised to pass legislation to ban abortions after 20 weeks, according to the Guttmacher Institute which tracks reproductive health issues. Arkansas and North Dakota went even farther, recently banning abortions that occur when a fetal heartbeat can be detected, which can happen as early as six weeks into a pregnancy.

On Friday, President Barack Obama criticized some of those laws in a speech to Planned Parenthood.

?A woman may not even know that she?s pregnant at six weeks,? he said of the North Dakota law.

Those who support abortion rights say Gosnell is a clear outlier who was in violation of dozens of existing laws.

"The important thing to remember is that Kermit Gosnell was running a criminal enterprise not a health care facility," said Eric Ferrero, a spokesman for Planned Parenthood, a pro-abortion rights group and the leading reproductive health care provider. (Planned Parenthood does not generally perform late-term abortions.)

"He was violating dozens and dozens of laws and regulations that were already on the books. New regulations would not have stopped him," Ferrero said.

Federal law requires health care providers to try to save the life of babies born alive during abortion procedures. Abortions after 21 weeks make up less than 1 percent of all abortions performed in the U.S. each year; the vast majority of abortions take place during the first trimester.

Others in the anti-abortion movement think the Gosnell case may help their cause to regulate clinics more strictly, as well as win over more supporters in the general public to their cause.

James Bopp Jr., the general counsel for National Right to Life, told Yahoo News that the case gives fuel to the argument that abortion clinics should be more strictly regulated. "When the realities of abortion are exposed to the public, it tends to be a rather gruesome business and people do react to that," Bopp said.

The Gosnell case has already prompted Pennsylvania lawmakers to pass a law that requires clinics to be regulated in the same way that outpatient surgery centers are. That means doors, hallways and elevators in the clinic must fit a stretcher, for example, in case a patient needs to be rushed to a hospital. Texas passed similar legislation.

Ferraro said such regulations tie up legitimate clinics in red tape, and would not have stopped someone like Gosnell--who is accused of flouting a number of federal, state and local laws--from criminal practices. The larger campaign to restrict abortion predates the furor over Gosnell, Ferrero said.

"Extreme activists and politicians will certainly try to use this to try to advance their agenda of making abortion inaccessible and unavailable for women, but that is clearly part of a larger, long term political agenda and political campaign among these folks," Ferraro said.

Meanwhile, the anti-abortion group Live Action, led by activist Lila Rose, released undercover videos Monday showing employees at two late-term abortion clinics explaining what would happen if a baby were born alive during an abortion to women they believed were patients.

One unidentified staff member at a Bronx clinic said babies born alive would be placed in a "solution" that would kill them. (The clinic's manager told The Washington Post a baby had never been born alive during an abortion there and that the staff member was uninformed.) A doctor in Washington D.C. is seen on the tape saying he would be legally obligated to help a baby born alive, but that it would probably die.

In an interview, Rose said she was not interested so much in convincing politicians to ban late term abortions, but rather to change "hearts and minds."

"I think the most important thing is making sure that every person and particularly women in America know exactly what these procedures are and what they do," she said.

Owner of collapsed Bangladesh building arrested

SAVAR, Bangladesh (AP) ? The fugitive owner of an illegally-constructed building that collapsed in Bangladesh in a deadly heap last week was captured Sunday at a border crossing with India by members of a commando force.

Mohammed Sohel Rana was arrested in Benapole in western Bangladesh, just as he was about to flee into India's West Bengal state, said Jahangir Kabir Nanak, junior minister for local government. Rana was brought back by helicopter to the capital Dhaka where he faced charges of negligence.

Rana's capture by the Rapid Action Battalion brought cheers and applause when it was announced on a loudspeaker at the site of the collapsed building in the Dhaka suburb of Savar, where search and rescue operations were continuing through the night.

At least 377 people are confirmed to have died in the collapse of the 8-story building on Wednesday. Three of its floors were built illegally. The death toll is expected to rise but it is already the deadliest tragedy to hit Bangladesh's garment industry, which is worth $20 billion annually and is a mainstay of the economy. The collapse and previous disasters in garment factories have focused attention on the poor working conditions of workers who toil for as little as $38 a month to produce clothing for top international brands.

Rana was presented before the media briefly at the commando force's headquarters in Dhaka. Wearing a printed shirt, an exhausted and disheveled Rana was sweating as two security officers held him by his arms. A security official helped him to drink water after he gestured he was thirsty. He did not speak to the media during the 10-minute appearance after which he was taken away. He is likely to be handed over to local police who will have to charge him and produce him in court within 24 hours.

A small-time politician from the ruling party, Rana had been on the run since Wednesday. He last appeared in public in front of his Rana Plaza on Tuesday after huge cracks appeared in the building. However, he assured tenants, including five garment factories, that the building was safe, according to witnesses.

A bank and some shops on the first floor shut their premises on Wednesday after police ordered an evacuation, but managers of the garment factories on the upper floor told workers to continue their shifts.

Hours later, Rana Plaza was reduced to rubble, crushing most victims under massive blocks of concrete and mortar. A garment manufacturers' group said the factories in the building employed 3,122 workers, but it was not clear how many were inside it when it collapsed. About 2,500 survivors have been accounted for.

On Sunday, rescuers were supposed to start using heavy equipment to drill a central hole from the top to look for survivors and dead bodies. But the operation was delayed after rescuers located a woman inside the building, and were trying to pull her out.

Army Maj. Gen. Chowdhury Hasan Suhrawardy, the coordinator of the rescue operations, said so far rescuers have been manually shifting concrete blocks with the help of light equipment such as pickaxes and shovels.

The next phase will involve manual efforts as well as heavy equipment, including hydraulic cranes and cutters to bore a hole from the top of the collapsed building, he told reporters.

The purpose is to "continue the operation to recover both survivors and dead bodies. In this stage, we have no other choice but to use some heavy equipment. We will start it within a few hours. Manual operation and use of small equipment is not enough," he said.

The work will be carried out carefully so as not to mutilate bodies, he said. All the equipment is in place, "from a small blade to everything. We have engaged many private sector companies which supplied us equipment, even some heavy ones."

In rare good news, a female worker was pulled out alive on Sunday. Hasan Akbari, a rescuer, said when he tried to extricate a man next to the woman, "he said his body was being torn apart. So I had to let go. But God willing, we will be able to rescue him with more help very soon."

On Saturday, police arrested three owners of two factories. Also under detention are Rana's wife and two government engineers who were involved in giving approval for the building design. Local television stations reported that the Bangladesh High Court has frozen the bank accounts of the owners of all five garment factories in the collapsed building.

Rana was a local leader of ruling Awami League's youth front. His arrest, and that of the factory owners, was ordered by Prime Minister Sheikh Hasina, who is also the Awami League leader.

The disaster is the worst ever for the country's booming and powerful garment industry, surpassing a fire five months ago that killed 112 people and brought widespread pledges to improve worker-safety standards. But since then very little has changed in Bangladesh, where low wages have made it a magnet for numerous global brands.

Bangladesh's garment industry was the third largest in the world in 2011, after China and Italy, having grown rapidly in the past decade. The country's minimum wage is the equivalent of about $38 a month.

Among the garment makers in the building were Phantom Apparels, Phantom Tac, Ether Tex, New Wave Style and New Wave Bottoms. Altogether, they produced several million shirts, pants and other garments a year.

The New Wave companies, according to their website, make clothing for several major North American and European retailers.

Britain's Primark acknowledged it was using a factory in Rana Plaza, but many other retailers distanced themselves from the disaster, saying they were not involved with the factories at the time of the collapse or had not recently ordered garments from them.

Wal-Mart said none of its clothing had been authorized to be made in the facility, but it is investigating whether there was any unauthorized production.

Want a solar home? Consider batteries.

Most solar homes are still dependent on the grid, so when the grid fails, they lose power. But that's beginning to change as the solar industry begins to focus on battery storage as the next 'green' frontier.

By David J. Unger,?Correspondent / April 27, 2013

Workers install solar panels on the roof of a farmstead barn in Binsham near Landshut, Germany, last year. Currently, most solar homes don't have onsite energy storage. Typically, adding backup batteries to a solar home adds about 30 percent to the cost.

When superstorm Sandy barreled into Long Island last October, it flooded Raina Brett Russo's home.

"Basically, the ocean and the bay came together in my living room," Ms. Russo says. "It hit us really hard."

The basement and first floor were underwater, three cars were flooded, and to the amazement of her neighbors, the power did not come back on any sooner than theirs. With 10.4 kilowatts' worth of solar panels bolted to her roof and undamaged, shouldn't the Russo house have been an oasis of light and power?

Not quite. Like most solar installations today, Russo's panels are connected to, and reliant on, the broader energy infrastructure. When the grid fails, most residential solar panels also fail. But that's beginning to change. The next evolution of home solar will be not in the panels that create energy, experts say, but in the batteries that can store it.

"Storage to me is the holy grail of renewable technology," says Dan Juhl, head of Juhl Energy, a Minnesota-based clean-energy company that offers, among other things, a hybrid solar-storage system called SolarBank. "With solar and wind we can produce power ? no ifs, ands, or buts about it. And with a little storage, you're good to go."

The technology exists, but it comes at a price. Depending on a house's size, location, and consumption, storage adds about 30 percent to the cost of a solar installation, which averages $26,000. Also, batteries need to be replaced every six to 12 years, depending on whether they're used to provide energy at night or strictly as backup systems.

Some of that?cost may be offset by the savings from buying less power from a central utility. Then there's the benefit of having working lights, refrigeration, and a charged cellphone in the aftermath of a storm, say supporters of solar power. Still, battery storage will have to come down in price to be competitive with conventional backup generators.

Solar panels themselves were once considered cost-prohibitive. Those prices have since plummeted, thanks to technological advances and a rapidly growing global market. The same could happen for storage.

"Ten or 15 years ago the battery was an afterthought because the photovoltaic module was the new, exciting technology," says Dean Middleton, director of sales for renewable energy at California-based Trojan Battery Company. "Today, there's much more of a focus on the battery."

Energy storage topped the list of high-demand features in a December 2012 global survey of 400 solar in-stallers, system integrators, and wholesalers by IHS Inc., a Colorado-based business analysis firm.

One-third of respondents said they expect to use energy storage in more than 40 percent of the photovoltaic systems they install by 2015. "Energy storage is becoming an increasingly important feature for PV systems, and if suppliers are able to deliver products in line with the industry's expectations, the market for energy storage in PV could increase significantly over the next two years," says Sam Wilkinson, a manager at IHS, in a release.

The nascent market is getting a boost from the US government. In November, the Department of Energy awarded $120 million to Argonne National Laboratory in suburban Chicago to lead research into better and cheaper batteries for vehicles and the electrical grid.

In the meantime,?lead-acid batteries will do the trick. The technology is time-tested and well understood, unlike newer and more volatile storage systems. Batterymakers say that storage of lead-acid batteries, despite their ominous name, is clean, safe, and highly recyclable.

When combined with solar panels and a special inverter to direct the flow of energy to and from the various sources, the batteries offer a kind of energy security not available in most solar panel systems.

"While everybody is arguing about a smart grid and how it's going to work, anyone who installs this kind of system already has a smart grid right there in their home," says Mark Cerasuolo, senior marketing manager at OutBack Power Technologies in Arlington, Wash., which specializes in power conversion equipment. "Everything on your side of the meter is what really counts."

Four months passed before Russo and her family could move back into their storm-battered home. She is adamant about acquiring backup power for when the next storm comes. But Russo, cofounder of educational website EcoOutfitters.net, which is dedicated to demystifying the process of installing renewable energy systems, eschews conventional generators because of their emissions.

"Since we already have this solar system, let's use it as a backup," she says.

Two bizarre endings mar UFC 159 prelims

The UFC debut of two Strikeforce light heavyweights was spoiled by a odd ending. Ovince St-Preux beat Gian Villante in a majority technical decision after the fight was stopped because of an eyepoke.

After a back-and-forth, not entirely thrilling bout, St-Preux threw a punch and accidentally poked Villante in the eye. Villante stepped back and crouched down, indicating to referee Kevin Mulhall that there was a problem with the eye. Mulhall asked Villante if he could see, and Villante said no, he couldn't see.

At that point, Mulhall waved his arms and the fight was stopped. Villante protested, but the fight was over. Because the round had started, it had to be judged. The scores were 30-28, 29-28 and 29-29 in St-Preux's favor.

?I couldn?t see. He did poke me in the eye so I don?t know," Villante said after the fight. "He said the fight was over and I didn?t expect that because I was just reacting to his question. I got poked and my eye was closed up so I thought he would stop it but he didn?t he just kind of looked at me. I don?t understand how you score thirty seconds of a round and that?s how I lost? We were just getting going and I got poked in the eye. I don?t know what to say.?

Mulhall's stoppage followed the rule of the eyepoke rule, if not the spirit. When a fighter says he can't see, the fight is stopped. However, Mulhall could have used better communication and adherence to procedures. It would have been better if he explained to Villante that he didn't have time to recover and that the fight would be stopped if he said he couldn't see.

UFC 159's weird streak continued in the very next bout. Rustam Khabilov and Yancy Medeiros' fight was stopped halfway through the first round. Medeiros defended a Khabilov takedown attempt, but hit his hand awkwardly. His thumb ended up pointing a way thumbs are not supposed to point and the bout was stopped at 2:32 of the first round.

Two weird endings marred the preliminary card, but the UFC rarely lets a weird ending go. Quite often, these fights get a rematch, so don't be shocked if you see these fights happen again on a card this summer.

Maverick operator Digicel takes on the big boys in Myanmar

By Jeremy Wagstaff

SINGAPORE (Reuters) - Cellular operator Digicel Group Ltd jumped into Myanmar early and big, hiring staff, funding local sports, negotiating land deals for thousands of cell tower sites and signing up hundreds of partners for retail outlets.

The strategy helped propel it onto the shortlist for a mobile license in one of the world's last mobile frontiers, putting an operator that ranks 65th globally in terms of customers up against giants such as Vodafone Group Plc.

Whether its strategy pays off or not, industry insiders say, Digicel, largely unknown outside the Caribbean and some Pacific islands, has shaken up a usually conservative industry.

"They have been a disruptive force," said Roger Barlow, a Hong Kong-based telecommunications consultant who has worked in Asia for more than 25 years. "Some of the big guys tend to look down their noses at them but they shouldn't because they're becoming a credible player."

Myanmar this month short-listed 12 consortia for two licenses it plans to grant foreign operators in late June. The government wants to expand mobile penetration from less than 4 percent to up to 80 percent by 2015-16.

While Digicel is up against behemoths such as Vodafone, China Mobile Ltd and Telenor ASA, several other big players failed to make the list - among them South Korea's SK Telecom Co Ltd and Egypt's Orascom Telecom Holding SAE.

It's a vindication of sorts for Digicel's long-term approach. Business development director Frank O'Carroll led the charge into Myanmar in 2009. In early 2012 he persuaded the company to commit funds to build a local brand and prepare the ground so that if it did get the go-ahead it could roll out a service in a matter of months.

That entailed deploying hundreds of workers across the country to negotiate thousands of leases for base station sites, months before the government had even begun the tender process.

"There's not one square inch of the country we haven't been in," O'Carroll said in an interview in Singapore.

Its sponsorship of the national football federation has built brand awareness - of sorts. Lots of locals have heard of Digicel, O'Carroll said, though at least initially they were as likely to think it's a brand of battery as a cellphone operator.

It's a strategy, he said, that Digicel has been pursuing in much smaller markets for more than a decade.

"What we are doing in Myanmar is not unique to Myanmar," said O'Carroll. "The first country that Digicel as a company looked to get a license was Trinidad and Tobago. We did very the same thing. We were there, we leased the land, we rented local offices, we started a local team, sponsored big sports."

SMALL AND NIMBLE

Digicel has since set up shop in 31 markets, gaining 13 million customers. While none boasts a population above 10 million people, the company has taken on some major rivals, including America Movil SAB, Vodafone, Telefonica and Cable & Wireless.

"I don't think there's any fantastic science to it, but I do think it's our ability to move fast because we're small, we don't have this complex machinery that takes months and months to make decisions," said Vanessa Slowey, Singapore-based CEO of Digicel Asia Pacific, in an interview.

Making those decisions is Digicel owner Denis O'Brien, an Irish billionaire who first focused on small markets in the Caribbean after noticing that spectrum was being auctioned off in Jamaica. Eventually the Pacific beckoned.

Telecoms executive David Borrill recalls meeting O'Brien in his office after three years working for the incumbent operator in Samoa. "He went straight over to his library and opened the biggest atlas he had, turned to the Pacific and said, 'Tell me about this, where would you put an office here?'"

A few weeks later Borrill was back in Samoa, this time working for Digicel. The company bought out Telecom New Zealand's stake in the incumbent operator in 2006, and within six months had more than doubled its customer base.

Last financial year the company reported revenue of $2.5 billion, year-on-year growth of 14 percent and EBITDA of $1.08 billion, up 13 percent. It has 87 percent market share in Haiti, at least 75 percent in Jamaica and 92 percent of Papua New Guinea, according to Bank of America Merrill Lynch.

"Digicel is very astute in selecting the markets it enters," said John Hibbard, an Australia-based telecoms consultant. "It has to be convinced it will win a reasonable market share."

When it isn't, it's prepared to abort. In East Timor, for example, Digicel went so far as building cell towers, and assured the government that if granted a license it could cover more than 90 percent of the population within four months.

But, Digicel said, the government dragged its feet and ignored advice to issue only one license. So when it did eventually win one of the two on offer last year, Digicel turned it down. "Why would we invest $50 million to compete with two other operators, for the 40 percent that is left? It's crazy. So we handed our license back," said O'Carroll.

Digicel sold its assets to the other licensee Telin, a unit of Indonesia's PT Telkom. The company broke even on its Timor investment, said Digicel's Slowey, without giving details.

Such an approach is at odds with the industry's more conservative approach, where investment decisions must be highly rational and based on certain outcomes.

"Digicel doesn't have the institutional memory of other telcos," said Rob Bratby, a Singapore-based telecoms lawyer with Olswang LLP. "It's an example of a company with a different mental framework."

SOROS PARTNERSHIP

Digicel, however, has not had a free ride in Myanmar. The government turned down its proposal in 2012 to set up a joint venture with the incumbent operator, Myanmar Posts and Telecommunications, in favor of an open tender.

That has meant facing the diplomatic and financial muscle of some of the world's biggest and best-connected operators, prompting Digicel to take on its own partners: Yoma Strategic Holdings, owned by Serge Pun, a powerful businessman who, unlike many tycoons in Myanmar, isn't entangled in Western sanctions. The other member of the consortium: Quantum Strategic Partners, owned by financier George Soros.

The Soros-funded Open Society Foundations have long worked with exiles, refugees and dissidents, according to its website. Last year Soros said he would set up an office in Yangon.

Digicel shrugs off criticism that it lacks the experience of working in big markets like Myanmar, arguing that it's harder to work in lots of countries, whatever their size. Among the shortlistees, only France Telecom SA matches Digicel in the number of markets covered.

"Whether it's the smallest country in the world you deploy in or the largest, it's still the same building blocks, still the same issues that you must go through," said O'Carroll. "A lot of those same things, whether it's Nauru's 9,000 people or Myanmar's 60 million, we think are going to be identical."

Still no comment on DMC approval by House - Postbulletin.com ...

News release from Rep. Duane Quam's office -- interesting that his comments on the budget bill are secondary to comments on the education bill and include no reference to Destination Medical Center.

If he or other area Republican House members have put out statements on DMC's passage (as part of budget bill) Wednesday night, I haven't seen them.

For those of you keeping score at home, DFLers Kim Norton and Tina Liebling did put out statements.

House Moves Ahead with Damaging Changes to Education and Taxes

Rep. Duane Quam, Byron

On Tuesday, the Minnesota House debated and passed the Omnibus K-12 Education Finance bill, the largest single expenditure of our state?s budget. In our current budget, passed in 2011, we provided a 33 % increase and spent $15.5 billion. This budget also helped spur over $300 million in surplus that will be used to pay back the school shift. With $15.7 billion in funding for our public schools, the bill also creates millions in new bureaucratic mandates that funnel money outside of the classroom. Line items like new ?regional centers of excellence? aren?t necessary to improve the classroom experience for our kids.

Even more concerning, however, is the elimination of graduation standards that got slipped into the bill. Currently, Minnesota High Schoolers take several assessments in order to qualify for a high school diploma. Two of these GRAD (Graduation Required Assessment for Diploma) tests include the GRAD Writing Test given at grade nine and the Grade 10 Reading MCA. These tests are now on the chopping block.

Why would we remove statewide comprehensive standards for our students? Embarrassed by poor results in their metro school districts, some powerful education groups have applied great pressure on Governor Dayton and my Democrat colleagues in the legislature to do-away with these measurements. Unfortunately for our students, the pressure worked.

With great concern for our local schools and student readiness for post-graduation, I spoke with several teachers in our district and offered an amendment to the K-12 bill which would have kept a grad standard in place. Through an accumulation of scores across subject areas, my amendment would have allowed an overall positive score for students and teacher candidates to outweigh a potentially lower score in one subject area. It would have kept a state standard for our graduates and our new teachers in place.

My amendment was rejected by House Democrats and the elimination of crucial learning measurement benchmarks will march on.

On Wednesday night, the House also passed the largest tax increase in three decades. Paid for with new higher income taxes and a shift in lower and middle income brackets, the bill also brings about higher sales taxes on alcohol products and tobacco. One lesser known item in HF677 (Omnibus Tax Bill) is the elimination of the state?s charitable giving tax credit for those that itemize deductions, as well as the elimination of a tax credit for purchasing long-term care insurance.

With new taxes and fees totaling $3 billion over the next two years, people from our area across income levels will feel the bite of this stone-cold job killer. Businesses will have less to hire and grow jobs, and may raise prices or close down. Farmers will not see the property tax relief they deserve, because the bill is focused on metro-area interests. In all, the new taxes amount to over $500 for every man, woman and child in Minnesota, or $2000 for a family of four.

Both bills will now merge with Senate versions and return to the House before they are given final passage and sent to Governor Dayton.

Thank you for your input during these long weeks of session, I appreciate hearing from you.

No landing gear? No problem

The pilot of a private plane with stuck landing gear safely landed the plane on its belly?and in picture-perfect fashion. When the small twin-engine Cessna 414 skidded to a stop on a runway at the New Century Air Center in Gardner, Kan., there were no injuries.

A KMBC news helicopter captured footage of the plane's descent. Michelle Stauffer, a veteran pilot with over 30 years experience in the skies, spoke with the news station about the experience.

According to the report, she and her co-pilot, Terry Blake, were on their way to Wichita when they discovered their landing gear wouldn't go down. She and Blake called five different mechanics from the air, plus broke out the manuals and went through the procedures.

"I had Terry reading the manual to me," she said. "You've got to have directions, just in case there's something I forgot or something one of us forgot, but you just go through it step by step by step."

Eventually Stauffer realized she had no choice but to land the plane on its belly and hope for the best. It was an experience she said she never wants to repeat.

"As a pilot, it makes you stay current and makes you realize that's why you go out and practice and look at those procedures," she said.

[ADV] Safety At work ? 10 Relevant Tips For Start-up Companies ...

Health and safety at work doesn?t need to be as complicated as many professionals make it out to be. Basically it?s about knowing the risks your business could pose and putting reasonable measures in place to reduce the likelihood of these risks occurring.

To help clarify the matter, provided below are some top tips for ensuring that your start up business complies with current legislation and employment laws.

1. Have a designated person.

Appoint a competent and designated person or persons to be responsible for the management of health and safety in your business. This may include you, an employee or an expert from outside the organization.

2. Put a policy in place.

Draw up a health and safety policy for your business. Detailing how you will manage health and safety in your organization, the policy should include who is responsible for what and any procedures which should be followed. If you have less than 5 employees this policy doesn?t need to be in writing but it is best practice.

3. Identify the hazards.

Identify what the potential risks are to your employees, contractors and the public. Work as an organization to find solutions and measures to help reduce these risks. This process is known as a risk assessment. By involving everyone in the organization it makes it easier to ensure that any measures put in place are followed. Also employees may be aware of risks that the employer is unaware of.

4. Record everything.

Again: Its good practice and mandatory if you have more than five employees.

5. Training.

Provide adequate training, advice and information to all your staff, volunteers and contractors who work with your organization. Make sure a record is kept of any training that takes place. Also make sure that this training is evaluated and repeated if necessary. Legislation and procedures may change so you need to ensure that any training material is accurate and up to date also.

6. Workplace facilities and working environment.

Make sure you provide adequate facilities to support your staff such as toilets and wash facilities, clean drinking water, personal storage and rest room and canteen areas. Ensure that your employees receive adequate breaks and have a pleasant working environment. You need to consider air quality, temperature, lighting, suitable equipment, protective clothing, cleanliness, windows, fire safety.

7. First aid and ill-health.

Ensure adequate facilities are in place for first aid and ill health. Ensure the presence of first aid kits on each site and if necessary a trained first aider to deal with any accidents that may occur. All accidents, injuries or work related diseases must be recorded and in some events reported to the health and safety executive.

8. Display your Occupational Health & Safety Administration (OSHA) poster.

If you employ someone you must display the OSHA law poster (available through personnelconcepts.com). Alternatively, you should provide each member of staff with a pocket card. This poster highlights the employer and employees responsibility under current health and safety legislation. Also, it is possible to display the designated health and safety representative and first aider in the organization.

9. Get covered.

If an employee is hurt or injured as a result of work they may claim for compensation. Employer?s liability insurance will cover the employer if an employer makes a claim.

10. Keep up-to-date and communicate.

As an employer it is important to ensure that you keep up to speed with current legislation and health and safety news within your business sector. Ensure that policies and risk assessments are regularly reviewed to ensure that they are valid. Continually ensure that all the employees are kept up to speed with any amendments to policies and get employees involved at every stage as health and safety is a two way process.

Computer scientists suggest new spin on origins of evolvability: Competition to survive not necessary?

Apr. 26, 2013 ? Scientists have long observed that species seem to have become increasingly capable of evolving in response to changes in the environment. But computer science researchers now say that the popular explanation of competition to survive in nature may not actually be necessary for evolvability to increase.

In a paper published this week in PLOS ONE, the researchers report that evolvability can increase over generations regardless of whether species are competing for food, habitat or other factors.

Using a simulated model they designed to mimic how organisms evolve, the researchers saw increasing evolvability even without competitive pressure.

"The explanation is that evolvable organisms separate themselves naturally from less evolvable organisms over time simply by becoming increasingly diverse," said Kenneth O. Stanley, an associate professor at the College of Engineering and Computer Science at the University of Central Florida. He co-wrote the paper about the study along with lead author Joel Lehman, a post-doctoral researcher at the University of Texas at Austin.

The finding could have implications for the origins of evolvability in many species.

"When new species appear in the future, they are most likely descendants of those that were evolvable in the past," Lehman said. "The result is that evolvable species accumulate over time even without selective pressure."

During the simulations, the team's simulated organisms became more evolvable without any pressure from other organisms out-competing them. The simulations were based on a conceptual algorithm.

"The algorithms used for the simulations are abstractly based on how organisms are evolved, but not on any particular real-life organism," explained Lehman.

The team's hypothesis is unique and is in contrast to most popular theories for why evolvability increases.

"An important implication of this result is that traditional selective and adaptive explanations for phenomena such as increasing evolvability deserve more scrutiny and may turn out unnecessary in some cases," Stanley said.

Stanley is an associate professor at UCF. He has a bachelor's of science in engineering from the University of Pennsylvania and a doctorate in computer science from the University of Texas at Austin. He serves on the editorial boards of several journals. He has over 70 publications in competitive venues and has secured grants worth more than $1 million. His works in artificial intelligence and evolutionary computation have been cited more than 4,000 times.

Orders for US durable goods fall 5.7 pct. in March

(AP) ? Orders for long-lasting U.S. factory goods fell in March by the most in seven months. The drop reflected a steep decline in commercial aircraft demand and little growth in orders that signal future business investment.

The Commerce Department said Wednesday that orders for durable goods declined 5.7 percent in March. That followed a 4.3 percent gain in February, which was revised lower.

Weaker economies overseas and the impact of across-the-board government spending cuts have made businesses more cautious. That's reduced demand for manufactured goods. Spending on defense equipment also fell sharply last month.

Durable goods are items expected to last at least three years. Orders for durable goods tend to fluctuate sharply from month to month and economists cautioned against reading too much into one monthly decline.

A measure of business investment plans, which include industrial machinery and computers, ticked up 0.2 percent last month. Economists pay close attention to so-called core capital goods orders because they strip out more volatile defense and aircraft orders.

Increases last month in both orders and shipments of core capital goods suggest businesses spent more on equipment and software in the January-March quarter. That likely contributed to economic growth in the first quarter.

Still, most of the quarterly gain reflected a huge increase in January. Orders fell sharply in February and rose only slightly last month. That indicates businesses may be spending less on equipment in the April-June quarter, economists said.

"This doesn't look like we're entering some kind of downward spiral," said Jonathan Basile, an economist at Credit Suisse. "This seems like a downshift from stronger growth."

The overall decline in durable goods was exacerbated by a 48.2 percent fall in commercial aircraft orders. Boeing Co. reported that it received orders for only 39 aircraft, compared to 179 in the previous month.

Orders for defense aircraft and other military goods also dropped. That likely reflects the impact of automatic government spending cuts that began on March 1. Joseph LaVorgna, an economist at Deutsche Bank, noted that orders for defense equipment fell to their lowest level in over seven years.

Excluding aircraft and transportations demand, orders dropped 1.4 percent, the second straight decline.

Demand fell in most types of goods. Orders dropped for metals such as steel and aluminum, metal parts, electrical equipment and appliances, and defense aircraft. Orders increased for computers and communications equipment.

Many economies overseas are also sluggish, reducing exports. China's manufacturers grew at a slower pace in March, according to a survey released Monday, as export orders and employment declined. Europe's economy has been in recession.

Rockwell Automation, which makes machinery and software for mostly industrial customers, said Wednesday that its first-quarter sales in Asia dropped 16 percent compared with the same period a year earlier. Demand slowed in China and India.

Sales ticked up just 2 percent in the United States. Ted Crandall, Rockwell's chief financial officer, said ongoing uncertainty about U.S. budget policies "may have caused some customers to hold back a little bit on capital spending."

The U.S. economy likely grew at a healthy 3.1 percent annual rate in the first quarter, up from only a 0.4 percent rate in the fourth quarter. The Commerce Department will release its first estimate for January-March growth on Friday.

But many economists expect growth has begun to slow to a rate of 2 percent or less in the current April-June quarter.

Higher Social Security taxes have reduced Americans' take-home pay this year. That's starting to limit their spending power. The government spending cuts will also likely weigh on growth.

Other reports suggest that manufacturing is starting to weaken after showing signs of strength over the winter. Strong auto production hasn't been enough to offset broader slowdowns in other industries.

Factory output slipped in March, according to a Federal Reserve report last week. And a survey of purchasing managers earlier this month found that manufacturing expanded at a slower pace in March compared with February. The Institute for Supply Management's survey showed that new orders and production declined sharply.

P&G, AT&T drop after earnings, holding back Dow

NEW YORK (AP) ? Weak earnings forecasts from Procter & Gamble and AT&T held the Dow Jones industrial average back on Wednesday.

P&G, the world's largest consumer goods maker, fell 4.8 percent to $78.03 after the maker of Tide detergent and Gillette razors said its revenue fell short of the expectations of Wall Street analysts. The company also issued a weak profit forecast for the next quarter. AT&T dropped 5.9 percent to $36.70 after it lost phone subscribers from its contract-based plans for the first time as sales of smartphones slow.

Those declines were enough to keep the 30-member Dow in the red, despite more stocks rising than falling in the index. The Dow was down 24 points by noon Eastern time.

In the broader Standard & Poor's 500 index, the earnings news was mixed.

Yum Brands, which owns KFC, Pizza Hut and Taco Bell, was among the gainers, advancing 7 percent to $68.70. Yum reported earnings late Tuesday that exceeded the expectations of financial analysts. General Dynamic, the aerospace and defense company, also surged after posting a profit that was better than expected. The stock jumped 5.3 percent to $70.66.

Other companies, including home appliance maker Whirlpool and drug maker Eli Lilly, disappointed investors.

The Dow Jones industrial average was down 0.2 percent at 14,695. The S&P 500 index rose one point, or 0.1 percent, to 1,579. The Nasdaq composite was down six points, or 0.2 percent, at 3,264.

While the majority of companies have been exceeding Wall Street's expectations on earnings, their performance on sales hasn't been as strong, suggesting that they are struggling to grow.

About 67 percent of S&P 500 companies that have reported earnings so far have beaten expectations, better than the 10-year average of 62 percent, according to S&P Capital IQ. However, only 42 percent have beaten revenue forecasts.

Company earnings so far have been consistent with signs that the global economy is slowing, said Jim Russell, a regional investment director at U.S. Bank. Russell said it's too early to conclude whether the slowdown will be short-lived.

"We think that most managements are appropriately cautious in their outlooks, because it's very possible that the second-quarter will continue to slow," said Russell. "We're watching with cautious optimism that this is a second-quarter-only soft patch in the economic data."

A report Wednesday that orders for long-lasting U.S. factory goods fell more than economists expected last month added to the signs that global growth is cooling. The Commerce Department said orders for durable goods declined 5.7 percent in March following a 4.3 percent gain the previous month. February's figure was also revised lower.

Stocks logged their biggest weekly drop in five months last week after growth in China, the world's second-biggest economy, slowed. Weaker hiring and manufacturing growth in March have also weighed on the stock market this month.

The market's gains this month have been modest after a first-quarter surge that pushed both the Dow Jones and the S&P 500 to record highs. The Dow is up just 0.8 percent in April, the S&P 500 index 0.6 percent.

During the first three months of the year, the Dow and the S&P 500 averaged monthly gains of more than 3 percent, driven by optimism that the housing market was recovering and company earnings would continue to climb.

Among other companies that reported earnings, Boeing rose 3.6 percent to $91.27 after the airplane maker said its first-quarter net income rose 20 percent despite problems with the 787 Dreamliner. The company said it would still meet its financial and delivery targets this year even after the 787 was grounded in mid-January because of problems with its batteries.

Amgen plunged 6 percent to $105.80 after the biotech company's sales growth disappointed investors.

In government bond trading, the yield on the 10-year Treasury note, which moves inversely to its price, was little changed at 1.71 percent.

It's easy to forget that there's more to running a website than just picking a name, making it look good, and getting it advertised. Those seem to be the three core pieces of the puzzle, yet it is proper web hosting that actually keeps them all together and functional. Read-on if you'd like to know how you can make better choices with your hosting future.

If possible, pay for your web hosting with a credit card. Every year, several web hosts go out of business and just disappear without a trace. When a host disappears, its customers are typically left out of pocket. The customers that paid for their hosting with a credit card, however, are able to get a full refund of their annual hosting costs from their credit card provider.

If you're just building your first website, opt for shared hosting. There are two main types of hosting on offer: shared, which is cheap, but has fewer options, and dedicated, in which you get the works and lots of customizability, but you pay for the privilege. Good shared hosting plans can be had for just a few dollars a month.

Make sure you, and not your web host, controls your domain name. If you let your host control your domain name, you may be stuck with that host if you don't want to change domains. Some unscrupulous hosts won't release the domain info if you leave on bad terms. If you control the domain, you can point it at another host's nameservers and start fresh.

Go for Linux hosting unless you need to use certain applications or server-side languages. Linux hosting has a better reputation for uptime, stability, and resource use. Shared hosting that runs on Linux tends to be somewhat cheaper, as well. There are, however, certain applications that need Windows hosting, including Plesk, Microsoft Access, Silverlight, MSSQL, and ASP.net.

Instead of finding a great web hosting company, start your own web hosting company to service your own needs. This can provide many benefits including secondary income and free web hosting if your business takes off. This is a great way to think like an entrepreneur, and make some money instead of paying for web hosting.

When searching for the right web hosting service, you need to remember the importance of a website running 24 hours a day, 7 days a week without constant technical interruptions. Do your research, and know which companies are not just available and cheap, but reliable enough to trust with keeping your website up and running.

When choosing a web hosting service, refrain from going with the recommendation of friends or family who are not professionals. Though they may have had a good experience themselves with a certain provider, realize that their needs may be very simple compared to yours. Read reviews and advice from those who have needs similar to your own.

After you have your site up and going, it is important that you gather statistics about your site. These statistics tell you many things including how many customers and their actions. Find a great web hosting service that provides these types of statistics for you to make business decisions about.

When choosing a web hosting service, always check their record for down time. If you are conducting business through your website, you will almost certainly lose customers if they cannot access your website at all times, day or night. Check not only how many times they have outages weekly, but what the duration of these outages are.

free Drupal Hosting

If you are using your website primarily as a blog, choose a web host that will allow you to sync with popular blogging tools like Drupal. These tools are usually free and simple to use, but you will likely want to host them with a professional service. Choose one that allows you import the files directly into their platform.

Make sure that your web host provides regular software updates for the services they are providing you with. For example, if your website relies on Drupal, you should verify that Drupal updates are provided efficiently. This includes updates for plug-ins and themes as well. Many of these updates include new features and security fixes that are essential for your website.

If your site is a small, personal blog, consider using a free web hosting service like Drupal or a similar company. Sites like these are not adequate for large sites with a lots of traffic but can be ideal for smaller sites. Drupal, for example, offers a range of templates to give your site a unique, professional look and the company is constantly offering new services.

Now you understand why it is so very important, yet easily maintained. As long as you evaluate options and operate within your budget, there is no reason you can't obtain quality hosting that will be sufficient for quite a while. Once your business begins bringing in the huge-profits; you can investigate larger options.

Design Web Limited is a hosting company, offering unique products and services for individuals and businesses, with a focus on open source applications. Our goal is simply to be the best free Drupal hosting company we can be.

Police: 5 dead in shooting south of Seattle

FEDERAL WAY, Wash. (AP) ? Gunfire erupted at an apartment complex in a city south of Seattle and five people were shot to death, including a suspect who was shot by arriving officers, police said early Monday.

Officers responding to an emergency call at 9:30 p.m. PDT Sunday at the apartments in Federal Way encountered a chaotic scene, with bullets flying.

"When officers arrived there were still shots being fired," said Federal Way police spokeswoman Cathy Schrock.

They found two injured men on the ground in a parking lot. One of the men reached for a gun as police moved in to assist the two, she said.

At that point, officers opened fire. The suspect died but police said it wasn't immediately clear if it was from their gunfire.

The other man on the ground and a third man in the parking lot were found dead.

In a search of the complex, police found a fourth man dead in one apartment and a slain woman in another unit. Schrock said police were trying to determine if the woman was accidentally hit by gunfire.

A total of eight officers fired their weapons, Schrock said. All have been placed on administrative leave, per standard policy, as the investigation continues.

There was no immediate word what set off the shooting.

"We're gonna continue to go door to door in hopes that we can find some additional witnesses, and hopefully we won't be finding any more victims." Schrock said. "We still don't have any idea what started this disturbance tonight."

After police flooded the area and carried out searches, authorities said they were confident there were no more casualties from the shooting.

They said they did not think another shooter was on the loose or that there was an immediate threat to the public.

There were no reports of any officers being injured, and the names of the five people who were killed were not immediately available.

Federal Way is about 20 miles south of Seattle.
